of the Sale First Trade Registry (FTR) is NOT a Dealer. The FTR independent
partner/member is representing the owner of this item or vehicle! FTR
partner/member is providing advertising, marketing, and consulting service
for an individual, company, or dealer wishing to sell. The FTR
partner/member or a representative has physically viewed the item being
sold and information has come from the owner and from other published
sources. FTR partner/member is not responsible for any misrepresentation
by the owner or errors in published relevant material and technical
specifications. Statements of history and or repairs etc. are that of the
actual owner. If you have any question concerning the auction please call
the partner/member. The FTR partner/member will make every effort to
answer your questions promptly and before your purchase or the end of the
auction. Please have all questions answered BEFORE purchase or bidding.
Unless indicated otherwise, this item is being sold without a warranty. It
is sold AS IS and WHERE IS. The description of the item being sold is for
informational and narrative purposes only. Information containing serial
numbers, engine numbers, trim numbers and other codes with reference to
the authenticity of any item offered
is guaranteed to be the same
as that found on any item or vehicle's ID plate or trim plate or any other
numbers found stamped into a vehicles engine block, cylinder heads,
transmission, differential or other mechanical components which are a part
of the vehicle.
The FTR independent partner/member cannot and
will not guarantee documentation, authenticity, body repair, mechanical
work, frames, titles, odometer discrepancies, matching numbers, stamped
engines, trans, rear end, vin tags, cowl and trim tags, or casting numbers
for all items or vehicles that we advertise or market that get sold. We do
not own them. The potential for reproduction paper documentation exists,
as well as restamped engines and reproduced trim/data tags. These do
exist because of the technology and the machine work in the Classic Car
market today. The FTR partner/member has made a diligent effort to
accurately describe this item but does not expressly or implicitly
guarantee the accuracy of the above description. Prospective purchasers
are cautioned to conduct their own due diligence, including a physical
inspection in person or through a qualified third party inspector or
appraiser before purchasing this item. We would welcome such an inspection
and will offer use of our 8 page professional vehicle inspection form to
your third party inspector or appraiser. The item offered for sale is subject to being sold at prices higher
than the highest sale price or bid before the end of the sale or auction
if the purchase price or reserve has not been met. Unless and until the
buyer has placed a deposit on the item, the item remains for sale. Buyer
has 10 days from the day of a deposit is received or close of the auction
to inspect the vehicle or have a 3rd party professional inspection done.
First Trade Registry must receive a ...REASONABLE DEPOSIT... (Certified
Check, Cashier’s Check or Money
Order). PayPal or Wire Transfer (bank to bank money transfer) is accepted,
with the buyer paying transaction charges. This deposit is
refundable if the item is proven to have been misrepresented in any way
whether intentionally, accidentally or unknowingly!
The buyer or winning bidder has 10 days from the
day a deposit is received or of close of the auction to inspect the item
or have a 3rd party professional inspection done. First Trade Registry can
arrange for a 3rd Party Vehicle Inspection. If ten days pass, OR the item
has been inspected by the buyer or winning bidder or a
representative of his/her choice and said inspection is approved by buyer,
the balance (Sale Price or Winning bid less the REASONABLE DEPOSIT) must
be paid to the seller. For the most part, the items being offered are
old/used, they are not perfect, and it is unreasonable to assume that
every single flaw of the item can be listed. Such deficiencies as in paint
or body, a small dent or scratch, or as an engine with grease or oil on
it, a light not working, etc., does NOT constitute refusing to buy the
car. Major rust/rot, undisclosed problems with the frame, would constitute
a legitimate reason for the buyer to refuse to purchase the item. In that
situation, there will be an attempt made to negotiate with the seller and
buyer to reach an agreeable solution. If the sale is not completed, the
Seller will retain $150 of the down payment to cover cost and effort in
re-advertising. Seller reserves the right to resolve any disputes before
the buyer has taken item or vehicle possession by refunding any payments. Seller Commonsense Disclaimer - The seller will make himself
available at anytime during the auction for a vehicle inspection. He will
point out the engine numbers, VIN, data plate and engine stampings etc. He
does not guarantee that the engine or any other component on the vehicle
is in fact the original or correct part for the item or car. Further, the
seller cannot guarantee the originality/condition of this item or vehicle
which includes, but is not limited to, the engine, transmission, matching
numbers, color, data tags or documentation. Unfortunately, the potential
for restamped engines and reproduced trim/data tags exist in the Classic
Car market today. The entire risk as to the originality/condition of the
item or vehicle and inspection before it is purchased is the
responsibility of the buyer. The buyer must represent that he/she has had the opportunity to
have or has had the item or vehicle inspected prior to purchase. The buyer
accepts the item or vehicle with all advertised equipment, options and
accessories in "AS IS" condition with any faults or defects. The
buyer will bear all future costs of repairing or correcting any defects
that exist or may occur in the future. The seller will have no
responsibility or liability for any consequential damages or injury caused
by any failure or malfunction of the item or vehicle or any components.
This item or car is being offered for sale by owner. The buyer and seller
acknowledge that if the transaction is consummated, that buyer agrees that
in the event of any dispute or disagreement between them relating to the
agreement of sale, the laws of the State/Province that the item or car is
located / sold in shall govern the rights and duties under the agreement
and that the signing of said agreement shall be construed to have occurred
